1. Scope of Application
The following General Terms and Conditions (AGB) apply to all orders placed by consumers and businesses through the online shop of CANNA COLES.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person, or a legal partnership, acting in the exercise of their trade, business, or profession when entering into a legal transaction.
For businesses, these AGB also apply to future business relationships without the need for explicit reference to them again. If businesses use opposing or supplementary terms and conditions, their validity is hereby rejected unless explicitly agreed upon by CANNA COLES.
2. Contract Partner, Contract Formation
The purchase contract is concluded with CANNA COLES.
By listing products in the online shop, CANNA COLES makes a binding offer to enter into a contract for these items. The ordering process allows you to place products in your cart without obligation and make corrections to your entries before submitting a binding order. The contract is formed when you accept the offer for the items in your cart by clicking the order button. You will receive an immediate confirmation via email after submitting your order.
3. Contract Language and Storage
The available contract languages are English.
The contract text is stored by CANNA COLES and sent to you along with the order details and the AGB via email. You can also view the contract text in your customer account.
4. Delivery Terms
In addition to the product prices indicated, shipping costs may apply, as described in the respective offers.
Deliveries are made exclusively via shipping. Self-collection of the goods is not possible.
5. Payment
The following payment methods are available in the CANNA COLES online shop:
- Bank Transfer: Payment details will be provided via a separate email. Shipment occurs after the payment is received.
- Credit Card: Enter your credit card details during the order process, and the payment will be processed automatically.
- PayPal: Payments are processed via PayPal; no PayPal account is necessary depending on the selected option.
- Amazon Pay: Payment is made via your Amazon account.
- Other Services: Depending on your location, options like Skrill, Klarna, or other local payment services may be available.

6. Retention of Ownership
The goods remain the property of CANNA COLES until full payment has been made.
For businesses: The retention of ownership applies to all claims arising from ongoing business relationships.
7. Transport Damage
- Consumers: Please report any obvious transport damage to the delivery carrier immediately and contact us as soon as possible.
- Businesses: The risk of accidental loss or deterioration of the goods passes to you upon handover to the shipping carrier.
8. Warranty and Guarantees
The statutory warranty rights apply unless otherwise agreed.
- Consumers: Claims for defects in used goods are excluded if they occur more than one year after delivery.
- Businesses: The limitation period for defect claims is one year from the transfer of risk. Used goods are sold without warranty.

9. Liability
CANNA COLES is fully liable for damages caused by intentional or grossly negligent breaches of duty, as well as for damages to life, body, or health. For slight negligence, CANNA COLES is only liable for breaches of essential contractual obligations, limited to foreseeable damages.
10. Dispute Resolution
The Australian Competition and Consumer Commission (ACCC) provides guidance on consumer rights and dispute resolution. CANNA COLES is not obliged or willing to participate in alternative dispute resolution processes before a consumer arbitration board.
11. Final Provisions
For businesses, Australian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes is the business location of CANNA COLES, provided you are a registered trader.
